Terms of Service
Please read these terms before using Aemote.
1. Acceptance
By creating an account or using the Aemote app ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms constitute a binding agreement between you and Aemote ("we", "us", "our").
2. Eligibility
You must be at least 18 years old to use Aemote. By using the Service, you represent that you meet this requirement. We do not knowingly allow persons under 18 to create accounts.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
You may delete your account at any time from within the app (Profile → Delete Account). Deletion is immediate and permanent.
4. Permitted Use
Aemote is a personal emotional wellness journaling tool. You may use it for your own personal, non-commercial purposes in accordance with these Terms.
5. Prohibited Use
You agree not to:
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Reverse-engineer, decompile, or disassemble any part of the app
- Use the Service to store or transmit unlawful, harmful, or abusive content
- Scrape, harvest, or systematically extract data from the Service
- Use the Service on behalf of any third party without their knowledge and consent
- Circumvent any security or access control measures
6. Not a Medical Service
Aemote is a wellness journaling tool, not a medical device, clinical service, or mental health treatment. The content in the app, including educational guides, emotion definitions, and The Change Triangle® tool for emotional health, is provided for informational and personal development purposes only.
Aemote is not a substitute for professional mental health treatment. If you are experiencing a mental health crisis, please contact a qualified healthcare professional or emergency services.
We are not a healthcare provider, health plan, or healthcare clearinghouse, and the Service is not subject to HIPAA or similar healthcare regulations.
7. Therapist Connections
Aemote lets you optionally connect with a mental health professional. This feature is entirely under your control:
- Connecting with a professional is optional and only happens at your direction, by entering a connection code.
- Any professional you connect with is your own provider. Aemote merely facilitates the connection — we are not a party to your therapeutic relationship and do not supervise, vet, or endorse any professional.
- Your entries are private by default. You decide which entries are shared, and you or the professional may revoke the connection at any time.
You are responsible for choosing who you connect with and for what you choose to share.
8. Intellectual Property
All content, design, code, and materials in the Service are owned by or licensed to us. You are granted a limited, non-exclusive, non-transferable licence to use the app for personal purposes in accordance with these Terms.
This Section 8 does not apply to The Change Triangle®, Emotions Education 101™, or It's Not Always Depression content, which are not owned by or licensed to us and remain the property of Hilary Jacobs Hendel and Change Triangle LLC. See Section 9.
Your personal data — your emotion logs, maps, and journal entries — belongs to you. We do not claim ownership of your content.
9. Trademarks and Attributions
The Change Triangle® tool for emotional health, and the ideas and content it draws on, are the work of Hilary Jacobs Hendel. Aemote is an independent application and is not affiliated with, endorsed by, or sponsored by Hilary Jacobs Hendel, Change Triangle LLC, or the AEDP Institute.
The following notices apply to marks and content used in the Service:
- The Change Triangle® is a trademark of Hilary Jacobs Hendel, Change Triangle LLC, New York, NY.
- It's Not Always Depression © 2018, Change Triangle LLC.
- Emotions Education 101™ is a trademark of Hilary Jacobs Hendel and Heather Sanford.
10. Availability & Changes
We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where possible. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
12. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising out of or related to your use of or inability to use the Service.
Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or AU$10 if you have not made any payments).
13. Governing Law
These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Queensland, Australia.
